The 35% fee will be applied directly to your selected collection total and the remaining balance of your collection will be due Before or at the time of the session. Remaining balance can be paid in cash, check, or digital invoice! Let Timeless Focus Photography know which you'd prefer! If you have to reschedule session for any reason, 35% non-refundable Fee will transfer to a new session date! If a new date is not able to be scheduled within a year, client will forfeit the non-refundable 35% Fee. 35% Non Refundable Session Fee * YES Liability Timeless Focus Photography owns and secures high quality cameras, equipment, memory cards, and computers to photograph and process your images. However, malfunctions can occur through circumstances beyond control. Timeless Focus Photography will not/cannot be held accountable or liable for any images lost or damaged including but not limited to equipment malfunction, natural disasters, technical errors, or computer malfunctions etc. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns. Liability * YES Model Release Timeless Focus Photography utilizes social media sites as a way to offer “sneak peaks” and photo sharing. In order to post the photos from this session to any type of online account such as social media sites or utilize your photos in any way for advertising, client examples, or sharing, a model release is required. Upon signature, you are providing permission for the release to apply to all individuals who are being photographed at the identified session. For valuable consideration received, I grant Timeless Focus Photography the absolute and irrevocable right and unrestricted permission concerning any photographs that she has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if she so chooses. I release and discharge Photographer from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom she took the photographs. Model Release * YES Images As noted in the model release section, ownership of the images will indefinitely be the property of Timeless Focus Photography. Your images may take 2-3 weeks to be fully edited and delivered. However, during peak photography season, this can be longer. Should you need the images sooner, please do not hesitate to contact me and I will work with you to provide your images as your need arises. Also, each individual image is processed to perfection. PLEASE do not edit these photos or apply any filters or presets from ANY program or social media to the images, it would be considered a breech of this contract. If you are requiring any additional edits or changes to the images, I would be happy to do so PRIOR to any images being ordered, downloaded, or saved. Once images have been downloaded, ordered or saved, no additional edits will be provided. Client downloading, ordering, sharing, or saving the session in any way is an agreement that client is satisfied with images and final session result. Upon downloading the images, long-term digital image storage becomes clients responsibility and client releases Timeless Focus Photography from any expectation or requirement that images be stored or saved past 60 days of gallery delivery. Also as noted, all images will be delivered via an online digital gallery platform, Shootproof. Images must be ordered or downloaded from Shootproof only. Sessions delivered via ShootProof are only limited to be accessed within 60 days of the gallery being delivered. Once you place your online order, a digital download email will be sent to you. Digital Download emails expire after 7 days and images must be downloaded prior to the link expiring. If client requires a download link be re-opened, a $25.00 retrieval fee will be assessed. Due to session volume, it is necessary to keep the albums to a time limit. If this is a concern or there are technical issues, please contact me immediately so we can work on successfully getting your images delivered to you!
